Terms and Conditions

Last updated: 20 October 2026

3DVOX, Villa de los Olivos 147, Real del Bosque, León, Guanajuato, Mexico (“3DVOX”, “we”, “the company”) operates a plugin and an internet platform (3dvox.app and my.3dvox.app) to create, upload, host, manage and share interactive three-dimensional models, mainly of architectural projects. Our tools turn your designs (including 2D plans) into optimized 3D models that are ready to use on the web. These terms and conditions govern your access to and use of the Services and any free trial.

By clicking a box indicating your acceptance of these terms, by placing an order with us (electronically through our websites or otherwise in writing), or by registering for an account (free or paid), you agree to be bound by all the terms and conditions in this document, any order and our other operating rules and policies, including our Privacy Notice (together, the “Agreement”). If you do not agree to all of them, you may not create an account or use the Services. If you have any questions about us or the Services, contact us at info@3dvox.com.

1. Definitions

2. Services

3DVOX provides the Services according to the Plan you purchase, as shown on my.3dvox.app at the time of purchase. Your Plan lets you host 3D models (“3D Models”) under the 3dvox.app domain with the features and number of spaces it includes. You publish your 3D Models with the 3DVOX plugin and manage them from my.3dvox.app.

Access rights: subject to your compliance with the Agreement and the payment of the applicable fees, you may publish and share your 3D Models within the Scope of your Plan.

3. Use restrictions

Except as expressly set out in the Agreement or allowed by local law, you agree:

(a) not to alter or modify the whole or any part of the Services, nor allow them to be combined with or incorporated into other programs, unless agreed in writing. This does not apply to embedding your 3D Models in other websites or media, or other integrations that are a normal feature of the Services, within your Scope;

(b) not to disassemble, decompile, reverse engineer or create derivative works based on the whole or any part of the Services, or attempt to do so;

(c) not to provide or make the hosting Services available to any other person, unless that is a normal feature of the Services;

(d) not to use the Services or the 3D Models for illegal or unethical purposes or in any way that infringes third-party rights;

(e) to comply with all technology control or export laws and regulations that apply to the technology used or supported by the Services; and

(f) to stay within the Scope of your Plan and use only the features it includes.

3D Models: you acknowledge that 3D Models are interactive representations, not exact surveys. They should not be treated as exactly to scale and must not be used for construction, renovation, exact measurements or any other use that requires exact measurements.

4. Availability and support

Availability: we will use our best efforts to keep the Services available 24 hours a day, seven days a week, except for maintenance, which may happen at any time with or without notice. The Services are provided “as is” and “as available”: we do not guarantee that they will be uninterrupted or error-free, and we are not liable for delays or lack of access caused by communication networks and facilities outside our control.

Support: we offer support during business hours at info@3dvox.com.

5. Your responsibilities

Account: you are responsible for the security of your 3DVOX account. You and your Authorized Users must keep your passwords confidential. You are responsible for all activity under your account and must notify us immediately of any unauthorized use or security breach. We may disable your account and terminate the Agreement if, in our reasonable opinion, you have materially breached sections 3 or 5.

Applicable laws: you will comply with all laws and regulations that apply to your use of the Services and, if applicable, that of your Authorized Users.

Content: for any material, data or information that you or your Authorized Users upload, input or ask us to enter on your behalf (“Content”), including plans and models, and whenever you share, embed or make material available to third parties through the Services, you must comply with the content standards below. You are responsible for your Content (including its legality, reliability, accuracy and quality) and agree to indemnify us for any loss or damage we suffer because you breach these standards. You represent and warrant that your Content:

(a) does not infringe third-party property rights, including intellectual property rights; (b) is accurate when stating facts and genuinely held when stating opinions; (c) complies with the laws of any country from which it is posted; (d) contains nothing defamatory, obscene, offensive, hateful, inflammatory or illegal; (e) contains no viruses, worms, malware, trojans or other harmful content; (f) does not promote sexually explicit material, violence, or discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (g) is not made in breach of any legal duty owed to a third party; (h) does not violate the privacy or publicity rights of third parties; and (i) is not likely to mislead anyone, including about your identity or the source of the Content.

We may (but are not obliged to) reject or remove any Content that, in our reasonable opinion, breaches the Agreement, is harmful or objectionable, or infringes third-party rights. We may also disclose your identity to a third party who claims that your Content infringes their intellectual property or privacy rights.

Visitor requests: if you enable “Request info” on your models, you are responsible for the personal data your visitors send you and must use it lawfully. We store and deliver it on your behalf as described in section 11 and our Privacy Notice.

6. Our rights to Content

Between you and 3DVOX, you own the Content you share on or through the Services (except anything generally available publicly or from other sources). To provide the Services, you grant us and our service providers a non-exclusive, royalty-free, worldwide, perpetual and transferable right to use, reproduce, distribute, prepare derivative works from, display and perform the Content for and in connection with (i) operating the Services and (ii) generating and presenting your 3D Models; this use after the end of the Subscription Term will not include your personal data without your express written permission. We may use anonymized Content at any time to provide our services. You warrant that you have all the rights, licenses and consents needed for us to use the Content under the Agreement.

7. Intellectual property

We own or license all intellectual property rights in the Services and in the software, documentation and materials accessed through them (subject to section 6). These works are protected by copyright laws and treaties worldwide, and all such rights are reserved. Except as expressly stated or needed for the Services to work, the Agreement grants you no rights in them. 3DVOX may show an attribution such as “by 3DVOX” on 3D Models; when your Plan requires it, it may not be altered or removed.

8. Plans, payments and AI Credits

Hosting fees: Plans are billed monthly, per hosted space, in advance (“Subscription Fees”), at the prices shown on my.3dvox.app when you subscribe. The first charge is made when you subscribe and then on the same day each month while the subscription is active.

Changing your Plan: adding spaces takes effect immediately and is charged right away, prorated for the rest of the current period. Removing spaces or cancelling takes effect at the end of the period already paid; no partial refunds are given for that period.

AI Credits: AI Credits are bought in prepaid packs with a one-time payment. They do not expire, are used at the credit cost shown before each AI render or video, have no cash value, cannot be transferred to another account and are non-refundable except where required by law. If a payment for AI Credits is refunded or reversed, the corresponding credits are removed from your balance.

Payment: payments are processed by Stripe with the card or method you provide; we do not store your card details. You authorize us to charge the applicable Subscription Fees and purchases on their due dates. Fees are (a) payable in the currency shown at checkout (MXN or USD); (b) non-refundable unless the Agreement or applicable law says otherwise; and (c) inclusive of applicable taxes unless stated otherwise.

Suspension: if a payment fails and is not settled within 10 days of its due date, and without prejudice to our other rights, (a) we may disable your account and access to all or part of the Services until the amount owed (including any interest) is paid; and (b) interest accrues daily on the overdue amount at an annual rate of 10% above the Banco de México base rate in force from time to time, from the due date until paid in full.

Price changes: we may change our prices with at least 10 days’ notice. The new price applies from your next billing period. Continuing to use the Services after it takes effect means you accept it.

9. Subscription Term

Your right to use the Services continues during the Subscription Term. Subscriptions renew automatically each month for another month unless you cancel them or the Agreement is terminated under section 10.

10. Termination and refunds

Your termination: you may change your Plan or cancel at any time from my.3dvox.app (“Manage billing”) or by emailing us. Unless you are entitled to a refund under these terms or applicable law (which we cannot exclude), prepaid fees are not refunded.

If you use the Services as a consumer (not as a business), you may have a legal right to cancel your first purchase of a Plan and receive a refund as provided by applicable local law. To exercise it, notify us of your decision with a clear statement (for example, by email) within 14 days of the purchase, or any longer period provided by local law. We will refund you as required by that law, using the same payment method unless agreed otherwise, and may deduct an amount proportionate to the Services provided until you notified us. This right applies only to your first purchase of each Plan. By creating an account and purchasing a Plan, you request immediate performance of the Agreement.

Mutual termination: either party may terminate the Agreement if the other (a) materially breaches it and, where the breach can be remedied, does not remedy it within 30 days of notice; or (b) becomes insolvent, has an administrator or receiver appointed over it or its assets, enters into an arrangement with its creditors, ceases or threatens to cease business, or is subject to any analogous event in any jurisdiction.

Our termination: we may end a free trial at any time with prior notice. We may also terminate the Agreement and delete the information and data in your account (including Content) if (i) the Services are discontinued; (ii) we lose the right to provide them; or (iii) providing them becomes unlawful.

On termination: you must stop using the Services and pay any fees owed up to the termination date.

Survival: provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnification and limitations of liability.

11. Privacy and data security

Data privacy: in this section, “Personal Data” means data about a person who can be identified from it or by combining it with other information we have access to. We both must comply with the data protection laws that apply to us. You warrant that you have the right to give us the Personal Data in your Content so that we can use and process it lawfully under the Agreement. Where your Content (including your visitors’ requests) contains Personal Data and we process it on your behalf, we will:

(a) process it only on your instructions and as needed to provide the Services; (b) take appropriate technical and organizational measures against unauthorized or unlawful processing and accidental loss, destruction or damage; (c) ensure that anyone who processes it is bound to confidentiality; (d) transfer it outside Mexico only to service providers bound to protect it as applicable data protection law requires; (e) notify you without undue delay if we become aware of a security breach affecting it; (f) on your request, and in any case at the end of the Agreement, delete it or return it to you; (g) give you reasonable assistance to meet your obligations under data protection law; (h) keep the records needed to show that we comply with this section; and (i) allow you or your external auditor, on reasonable notice and under confidentiality, to audit our compliance, in a way that minimizes disruption to our business.

You consent to our use of subcontractors to process Personal Data (listed in our Privacy Notice), provided that (a) we notify you at least ten (10) days before changing one of them; (b) they are bound by terms that comply with data protection law; and (c) we remain responsible for their breaches of this section.

Backups: we are not responsible for backing up your Content; please keep your own copy of it at all times.

12. Disclaimer of warranties

To the maximum extent permitted by law, we do not warrant that defects in the Services will be corrected or that the Services, or the servers that make them available, are free of viruses or other harmful components. The Services were not developed for your individual requirements; it is your responsibility to make sure they meet them. You are responsible for the results you obtain from the Services and for conclusions drawn from them. To the maximum extent permitted by law, 3DVOX disclaims all other warranties, representations, conditions and terms implied by law.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable, whether in tort (including negligence), contract, misrepresentation or otherwise, for (i) any special, indirect or consequential loss or damage; (ii) the cost of substitute products or services; (iii) interruption of use or loss or corruption of data; or (iv) loss of profits, business or goodwill, arising out of or in connection with the Agreement.

We are also not liable (a) for third-party products or services you access through the Services; (b) for failures caused by networks, hardware or software not under our control; (c) for your acts or omissions; (d) for your use of the Services in breach of the Agreement; (e) for your use of a 3D Model when it is not hosted through our Services; or (f) for unauthorized access to the Services, including a malicious security breach.

To the maximum extent permitted by law, our total liability to you arising out of or in connection with the Agreement will not exceed the total fees you paid us under the Agreement in the twelve (12) months before the event that gave rise to the claim.

Nothing in the Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

The Services may contain links to third-party websites, provided for convenience or to enable certain features. We are not responsible for their content or for any contract you make with them; please review their own terms and privacy policies.

14. Indemnification

You agree to defend, indemnify and hold 3DVOX harmless from any claims, losses, damages, expenses and costs, including reasonable legal fees, arising out of your use of the Services in breach of the Agreement.

15. Changes to this Agreement

We may change the Agreement from time to time. Changes take effect when the updated version is posted on this page; when appropriate (for example, a price change) we will also tell you in advance by email. Continuing to use the Services after a change takes effect means you accept the updated Agreement. New features or services we offer in the future may be subject to additional terms.

16. Other important terms

Transfer: we may transfer our rights and obligations under the Agreement to another organization without affecting your rights. You may only transfer yours with our written consent.

Waiver: if we do not insist on or delay enforcing any of your obligations, that does not waive our rights. Any waiver must be in writing and does not apply to later breaches.

Severability: each term operates separately. If a court or authority finds any of them unlawful or unenforceable, the rest remain in full force.

Governing law and jurisdiction: the Agreement is governed by the laws of Mexico, excluding its conflict-of-law rules. You and we agree that the courts of Guanajuato, Mexico, have exclusive jurisdiction over any dispute arising out of or in connection with the Agreement.
